Terms of Service

Last updated: 1 October 2026

These terms apply when you use the services of Clicky Fyre LLC ("Clicky Fyre", "we", "us"): our Google Ads management services and our click-fraud protection tool Cinderblock (the "Portal", at iptracking.clickyfyre.com). By signing a proposal with us or using the Portal you agree to these terms. If a signed proposal or contract says something different, the signed document wins.

1. The service

Cinderblock checks visits from Google Ads to your website, scores how likely each click is to be invalid or fraudulent, and, if you choose, excludes the IP addresses of fake visitors in your Google Ads account and blocks them on your website. It also gives you reports, alerts and files you can use for refund requests and clean conversions. Which features are switched on for your account is agreed with you.

Google's own visits (Googlebot, AdsBot and ad reviewers) are never scored, blocked or shown a different page, and every visitor sees the same website content.

2. What we do not promise

  • No tool can catch every fake click, and some real visitors can look suspicious. Scores are our best judgement, not a certainty.
  • Money "saved" in reports is an estimate (fake clicks multiplied by an average cost per click).
  • Refunds or credits for invalid clicks are decided by Google alone. We help prepare requests but cannot promise any refund.
  • We do not control Google's systems, policies or decisions, and are not responsible for changes Google makes.

3. Your responsibilities

  • Give us correct information and keep your Portal login details private. Tell us straight away if you think someone else has used your login.
  • Only add the Cinderblock script or plugin to websites you own or are allowed to manage.
  • Your website's privacy notice must tell visitors that visits are checked to prevent fraud, and, where the law requires it (for example for UK and EU visitors), your cookie banner must ask for consent. We can give you suggested wording.
  • Follow Google's advertising policies for your ads and website.
  • Do not use the Portal to harm others, to break the law, to test or attack our systems, or to copy or resell the service.

4. Access to your Google accounts

When you give us access to your Google Ads or Google Analytics account, we use it only to provide the service described above. In Google Ads we only read reports and add IP address exclusions (and, if you choose, an excluded placement list); we never create or change ads, bids or budgets and never remove what you added. You can remove our access at any time in your Google account or by asking us. How we handle this data is explained in our Privacy Policy.

5. Fees and payment

Fees, billing period and payment terms are set out in your proposal or invoice. Unless agreed otherwise, fees are paid in advance and are not refundable for a period already started. Google Ads spend is paid by you directly to Google and is not part of our fee. We may pause the service if an invoice is more than 14 days overdue, after telling you.

6. Your data

The data collected from your website stays yours. We process it only to provide the service, as set out in our Data Processing Agreement, which forms part of these terms. Each client can see only their own data. We keep visit records for 90 days by default (or a shorter period you choose).

7. Confidentiality

Both of us will keep the other's non-public business information confidential and use it only for our work together. This continues after the service ends.

8. Our rights

Cinderblock, its software, design and reports format belong to Clicky Fyre. You get the right to use the Portal for your own business while your service is active. Reports we produce for you are yours to use.

9. Availability

We aim to keep the Portal available at all times but may need short breaks for updates or maintenance. The Cinderblock script and plugin are built to fail open: if the Portal cannot be reached, your website keeps working normally.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential losses (for example lost profit, lost sales or lost data), or for decisions made by Google. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

11. Ending the service

Either of us can end the service with 30 days' written notice (email is enough), or straight away if the other seriously breaks these terms. When the service ends we remove our script access, stop all changes to your Google Ads account (exclusions already added stay unless you ask us to remove them), and delete your website's visit data within 30 days, unless you ask for a copy first.

12. Changes to these terms

We may update these terms. The date at the top shows the latest version. We will tell active clients about important changes by email at least 14 days before they apply.

13. Law and disputes

These terms are governed by the laws of the State of Florida, United States. We will first try to settle any disagreement by talking; if that does not work, the state and federal courts located in Pinellas County, Florida decide. This does not take away any rights you have under the consumer or data protection laws of your own country.
